Poloncarz to hold hearing on fracking law next week

A hearing is set for 4 p.m. Dec. 30 for the public to comment on a new local law that was adopted by the Erie County Legislature to ban hydraulic fracturing on county owned property.

The law, which was adopted on Dec. 12 in a 9-2 vote of the Legislature, also prohibits the storage, disposal or treatment of hydro-fracking byproducts at county owned wastewater treatment facilities or its use on county roads.

County Executive Mark C. Poloncarz is required by the county Charter to hold a public hearing on any local law that is adopted by the Legislature. The county executive then has the discretion to either approve the local law or not. If the county executive decides to veto the local law, a two-thirds majority of the Legislature would be required to overturn the veto.

The hearing is scheduled to be held in Room 1404 of the Edward A. Rath county office building, 95 Franklin St.
