A Buffalo man today admitted breaking into Erie County Executive Mark C. Poloncarz’s parked vehicle and then his Buffalo home last summer as Poloncarz slept.
Avello Pena, 22, of Richmond Avenue, pleaded guilty to second-degree burglary and petit larceny, according to Erie County Assistant District Attorney Michael P. Felicetta.
Pena admitted taking money and a baseball bat from the vehicle and then entering Poloncarz’s Delaware Avenue residence, armed with the bat, at about 5:30 a.m. on June 17.
Pena pushed out a screen and climbed through an open downstairs window, awakening Poloncarz.
Pena stood on a recycling tote to reach the window, some 8 feet from the ground.
The county executive said he called police and yelled at the burglar, who fled with the bat. He said he ventured downstairs but never saw the thief.
Police responding to the 911 call arrested Pena a short time later. Officers noticed Pena running with a bat.
Pena, a second felony offender, faces seven to 15 years in prison when sentenced Jan. 28 by Erie County Judge Michael L. D’Amico, according to District Attorney Frank A. Sedita III.
