A Chautauqua County man, one of three ski-masked men armed with shotguns who broke into a Buffalo home last year looking for a man with drugs, was sentenced today to nine years in prison.
State Supreme Court Justice Christopher J. Burns sentenced Henry Lee Smith Sr., 51, of Fardink Road, Ashville.
Smith pleaded guilty in October to first-degree burglary and two counts of first-degree robbery for his role in the Sept. 26, 2012, break-in at the home of a Bennett High School teacher.
Smith admitted that he and his nephew, Quincy A. Smith, 37, of Fredonia, along with Steven McCool, 20, no address listed, entered the teacher’s home. The apparent target was the boyfriend of the teacher’s daughter, who had marijuana, synthetic LSD and ketamine, an anesthetic, prosecutors said.
Buffalo police apprehended McCool as he fled the home. Henry Lee Smith and his nephew were apprehended by investigators from the District Attorney’s Office.
Henry Lee Smith had faced up to 25 years in prison.
McCool pleaded guilty to second-degree burglary and was sentenced Oct. 30 by Erie County Judge Kenneth F. Case to one year in jail. McCool, who had been in jail since his arrest, had already served that amount of time.
Quincy Smith pleaded guilty to first-degree burglary and two counts of first-degree robbery and is serving a nine-year prison sentence.
