A 53-year-old Eden man who attempted to flee the scene of an accident was suspected of driving while under the influence of prescription drugs – for the fourth time this year, town police reported today.
Police were called at about 11 a.m. Tuesday about an accident on Eckhardt Road. A pickup had hit a culvert, bushes and a tree and the driver was attempting to flee, police said.
That driver, David A. Bemish, was held at the scene by Lt. John McCarthy, who was off duty at the time. Bemish was taken into custody by Sgt. Shawn Bishop.
Bemish was taken to Lake Shore Hospital, where blood and urine samples were obtained. He was charged with driving while intoxicated, and three violations of vehicle and traffic law.
Police said Bemish has three other pending cases related to driving while under the influence of drugs. He previously was arrested March 7 in Blasdell, and May 11 and Nov. 15 in Hamburg.
Following his arraignment Tuesday before Town Justice Michael Cooper, Bemish was released without bail on the condition that he doesn’t drive. Another court appearance is scheduled for Friday.
