Eden motorist jailed after 5th DUI arrest

An Eden man was sent to jail after his fifth arrest, within a year, related to driving while under the influence of drugs, according to town police.

Investigating a report about an erratic driver at about 10:30 a.m. Sunday, Sgt. Shawn D. Bishop found damage to two lawns on Nelson Drive, police said. A witness gave him a description of the pickup truck responsible for the damage, and it was found stuck on a lawn on Eckhardt Road.

Bishop opened the driver’s door and shut off the ignition. The driver, David A. Bemish, 53, resisted arrest, police said.

Bemish was taken into custody and charged with driving while intoxicated; two counts each of leaving the scene of a property damage accident, moving from lane unsafely and failure to keep right; operating without insurance; unregistered motor vehicle; and uninspected motor vehicle.

Bemish refused to provide blood and urine samples for testing, police said.

During arraignment, Town Justice Michael Cooper suspended Bemish’s license and sent him to the Erie County Holding Center in lieu of $20,000 bail.

Police said Bemish has four other pending cases related to driving while under the influence of drugs. He previously was arrested March 7 in Blasdell, May 11 and Nov. 15 in Hamburg and Dec. 17 in Eden.

Following the Dec. 17 arrest, Cooper had released him without bail on the condition that he not drive.
