Man who shot at ex-girlfriend’s dad pleads guilty

LOCKPORT – Donald L. Smith of Niagara Falls is headed for state prison for the third time after pleading guilty Wednesday to illegal gun possession in connection with shots fired at his ex-girlfriend’s father March 13, 2013.

Smith, 28, of LaSalle Avenue, is to be sentenced April 9 by State Supreme Court Justice Richard C. Kloch Sr. for attempted second-degree criminal possession of a weapon and for second-degree bail jumping, to which he pleaded guilty Nov. 8. Kloch promised that the sentences will be no more than five years and will run concurrently.

Smith, who went to prison on drug charges in 2005 and 2008, was charged with firing a pistol at Ralph Wallace in the 1300 block of Pierce Avenue. The bail jumping charges related to Smith’s failure to show up for a Niagara Falls City Court date on domestic violence charges Nov. 28, 2012.
